Tax time has come again and before we know it, the April 15th deadline will be here in a matter of weeks. For those who have been fortunate enough to purchase a home within the past year, here are some of the most common questions regarding the home buyer tax credit.

How Is the tax credit claimed?

The home buyer will claim the tax credit during the filing of their federal income tax. If you purchased a qualifying home in 2009 or 2010, you will need to complete IRS form 5405. In addition, you will need to enclose a copy of the settlement statement. Normally the settlement statement is a properly executed Form HUD-1.

Note: If you have purchased a newly constructed home of mobile home and the HUD-1 is not provided, you may include an executed retail sales contract for mobile homes or a copy of the certificate of occupancy for newly constructed homes.

Does the home buyer have to sell their current home in order to qualify for the $6500 repeat home buyer tax credit?

As long as this home is not used as the primary residence, it does not have to be sold for the buyer to qualify for the $6500 credit. The tax payer may continue to own both homes however, they must use the new home as their principal residence and live there for at least 36 months or repay the tax credit.

Do married couples both have to meet eligibility requirements to claim the credit even if their taxes are filed separately?

Yes, as mentioned in one of our previous post "Founders Of Home Buyer Tax Credit Web Site...Marriage Penalty", both spouses must meet eligibility requirements to qualify for the first time buyer's credit of $8,000 and the repeat buyer credit of $6,500. This is required even if the taxes are filed separately. On the contrary, if an unmarried couple purchases a home together, only one has to qualify and the other can still claim the full credit.

Do all home purchases need to be completed by the April 30th deadline to be eligible for the credit?

There are only two exceptions to this deadline and they are as follows:

If a buyer enters into a binding contract by April 30, 2010 then that buyer will  have until June 30, 2010 to complete the purchase.

If a buyer is apart of the uniformed services, Foreign Service or employees of the intelligence community that have been on qualified extended duty outside of this country within the past 90 days between January 1, 2009 and April 30, 2010, the deadline will be extended for one year (April 30, 2011).

Experts Suggest 4 Options to End Negative Equity

With the continuation of dropping home prices and families getting behind on their mortgage, experts feel that finding a solution for the underwater crisis may take some time. In addition to the Obama administration's plan to give 5 states 1.5 billion to devise programs to assist unemployed homeowners behind on their mortgages, experts feel these four options would also help.

Principal Reductions: Get rid of the negative equity. In order to do this, banks would need to modify loans as well as write down principal owed to reflect a home's value on the current market. Supporters of this solution feel that foreclosures are proving to be more costly. However, lenders will endure major losses if large portions of the loans are written down. In addition, complications may set in if there's a second mortgage or lines or credit.

Stabilize Home Prices: Some U.S. banks have started leasing foreclosed homes back to the original owners. In addition, home prices can be stabilized by controlling the release of distressed property into the current market.

Help for Unemployed Workers: The Mortgage Bankers Association is now considering a program that will give relief to home owners who have lost their jobs. The program would reduce mortgages for up to nine months to a more affordable rate which would be based on the income of the household. The National Bankers Association has requested for the government to add this tool to the Home Affordable Modification Program.

Freeze Foreclosure: Some experts feel that foreclosure freezes would give servicers the time to evaluate homeowners for loan modifications. The more people that are able to stay in their homes the closer we become to solving the problem of negative equity.

Remember, there are no specific requirements of what a market evaluation should include but these are the basics that can guide you in determining your position and the services offered by real estate professionals:

Solds -What a buyer is willing to pay is what the property is exactly worth. It's a good idea to study solds in for your location and surrounding areas.

Expireds - Listings that are terminated after being on the market for 30-90 days. These are normally overpriced homes based on current patterns of the buyers and property condition.

Currents - If you were to place your home on the market, how would it compare to others in the area?

Value Boosters - Minor home improvements can boost your property value. If needed, your real estate professional will offer some suggestions. It would be very wise to take note of what he or she suggest.

Value Range - You will be guided through the process of determining a range for your property with the key factors: solids, expired, and currents. Don't worry your real estate agent will explain the difference between range and absolute value.

Selling Cost - What you keep (the net) is what matters the most, not the list price or market value.

What Ifs - To complete your real estate value listing you will need example listings for moves "up" or "downsizing". Sometimes the greatest value can come from closing the price gap between your neighborhood and the "better" neighborhoods.
