4 Good Tax Laws for Home Owners To Be Aware Of

Although the economy and housing market had a few hurdles, remember there is still good news for U.S. home owners. With the creation of a variety of tax laws by U.S. lawmakers, home owners are finally filling some relief. Check out 4 tax laws that all homeowners should know.

Cancellation of debt income - 2007's Mortgage Forgiveness Debt Relief Act was one of the first housing related tax relief measures that was implemented. This act enables taxpayers to omit debt forgiven on a principal residence if foreclosure occurs or if the mortgage is reconstructed. Prior to this act, homeowners were required to pay taxes on the amount of forgiven mortgage debt. In the case of foreclosures, debt was canceled.

First Home Buyer Credit - This popular credit was created in 2008 and has encountered many modifications since. This tax credit law allows first time qualified home buyers to receive up to $8000 and $6500 for non first time buyers.

PMI Deduction - Normally, if a buyer gives a down payment of less than 20 percent, the lender will require private mortgage insurance (PMI) which will protect them if the buyer defaults. In addition, premiums must be paid which usually becomes apart of the monthly mortgage payment. However, the premium payments have been deductable as an itemized expense on certain home loans issued since 2007.

Note: If your adjusted gross income is $100,000 or more, or $50,000 or more if married and filing separately, your deducted PMI amount is limited. If you adjusted gross income is more than $109,000 or $54,500 if married and filing separately you will not get a deduction.

Property Tax Addition to Standard Deduction - This is another well known tax break on homes which has been expanded. Before, real estate taxes were popular tax deductions for those who homeowners who itemized. These payments could be used to increase tax payer's deduction totals.

Now, those homeowners who do not itemize can claim a portion of their real estate tax payments as part of the standard deduction. An additional $500 for single homeowners and an additional $1000 for joint filers can be added to the standard deduction amount of the taxpayer's.

Banks Become More Lenient With Homeowners By Deferring Evictions

Could it be that banks are starting to be a little more lenient to families who have fallen behind on their mortgage?

Families throughout the country have fallen behind on their mortgages but banks have decided to not force an eviction which enables families to remain in their homes.

Some key components that have been said to contribute to this growing trend includes government pressure on banks to modify loans so that U.S. families can remain in their homes. In addition, with numerous amounts of inventory in states such as Arizona and Nevada, banks are a little reluctant to placing more inventories into the market at this time.

One other component contributing to this trend includes the bank's desire to protect its investment. This is done when banks allow families to stay in their homes and begin negotiations with the homeowners.

Economists predict this will not last always however during the mean time, this will enable some owners to avoid eviction and get back on their feet financially.

Tax time has come again and before we know it, the April 15th deadline will be here in a matter of weeks. For those who have been fortunate enough to purchase a home within the past year, here are some of the most common questions regarding the home buyer tax credit.

How Is the tax credit claimed?

The home buyer will claim the tax credit during the filing of their federal income tax. If you purchased a qualifying home in 2009 or 2010, you will need to complete IRS form 5405. In addition, you will need to enclose a copy of the settlement statement. Normally the settlement statement is a properly executed Form HUD-1.

Note: If you have purchased a newly constructed home of mobile home and the HUD-1 is not provided, you may include an executed retail sales contract for mobile homes or a copy of the certificate of occupancy for newly constructed homes.

Does the home buyer have to sell their current home in order to qualify for the $6500 repeat home buyer tax credit?

As long as this home is not used as the primary residence, it does not have to be sold for the buyer to qualify for the $6500 credit. The tax payer may continue to own both homes however, they must use the new home as their principal residence and live there for at least 36 months or repay the tax credit.

Do married couples both have to meet eligibility requirements to claim the credit even if their taxes are filed separately?

Yes, as mentioned in one of our previous post "Founders Of Home Buyer Tax Credit Web Site...Marriage Penalty", both spouses must meet eligibility requirements to qualify for the first time buyer's credit of $8,000 and the repeat buyer credit of $6,500. This is required even if the taxes are filed separately. On the contrary, if an unmarried couple purchases a home together, only one has to qualify and the other can still claim the full credit.

Do all home purchases need to be completed by the April 30th deadline to be eligible for the credit?

There are only two exceptions to this deadline and they are as follows:

If a buyer enters into a binding contract by April 30, 2010 then that buyer will  have until June 30, 2010 to complete the purchase.

If a buyer is apart of the uniformed services, Foreign Service or employees of the intelligence community that have been on qualified extended duty outside of this country within the past 90 days between January 1, 2009 and April 30, 2010, the deadline will be extended for one year (April 30, 2011).
